RESOLUTION AND ORDER OF THE TOWN BOARD OF THE TOWN OF CLARENDON
SCHEDULING A PUBLIC HEARING REGARDING THE ESTABLISHMENT OF
TOWN OF CLARENDON WATER DISTRICT NO. 14

WHEREAS, at a special meeting of the Town Board of the Town of Clarendon, New York held at the Town of Clarendon Town Hall, 16385 Church Street, Clarendon, New York on August 8, 2025, the following resolution was offered by Board Member  Allen W. Robinson, who moved its adoption, seconded by Councilman Bruce A. Hovey; and

WHEREAS, the Town Board of the Town of Clarendon, New York (the “Town”) has caused a map, plan and report (the “Maps and Plans”) to be prepared by a licensed engineer and filed with the Town Clerk in connection with the proposed establishment and improvement of a water district in the Town to be known as Town of Clarendon Water District No. 14 (the “District”); and

WHEREAS, the boundaries of the proposed District are set forth in the attached Exhibit A; and

WHEREAS, the Town proposes to acquire, construct and install a water distribution system in the District including approximately 34,300 linear feet of 6” and 8″ water main, valves, hydrants, and appurtenances, together with all equipment, machinery or apparatus and land or rights in land required in connection therewith (the “Project”), all as more particularly described in the Maps and Plans; and

WHEREAS, the maximum amount proposed to be expended for the Project is $3,122,000; and

WHEREAS, there will be no hook-up fees for properties in the District that initially connect to the District, but any property owners not currently connected to the water system who choose to connect would be required to hire a contractor to tap the line and install the service line and appurtenances; and

WHEREAS, the cost of the proposed District to the typical property in the District in the first year following formation of the District (or, if greater, the first year in which both principal and interest on indebtedness and operation and maintenance costs will be paid) is estimated to be $3,454.72; and

WHEREAS, the proposed method of financing the costs of the Project consists of the issuance of serial bonds of the Town to mature in annual installments over a term of up to 40 years, payable in the first instance from assessments levied on benefited real property in the proposed District and any bond anticipation notes issued in anticipation of the sale of such bonds, said bonds to be offset by any federal, state, county and/or local funds received including, but not limited to, USDA Rural Development Agency and New York State Environmental Facilities Corporation grants; and

WHEREAS, the cost of the Project and related debt service will be assessed by the Town Board in proportion as nearly as may be to the benefit which each lot or parcel in the District will derive therefrom; and

WHEREAS, the Maps and Plans describing the foregoing, including a detailed explanation of how the estimated cost of the District to the typical property was computed, have been filed in the Town Clerk’s office and are available for public inspection during regular business hours.

NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the Town Board will hold a public hearing to hear all persons interested in the establishment of the Town of Clarendon Water District No. 14 and the proposed acquisition, construction and installation of the water system improvements, which public hearing shall be held at the Town of Clarendon Town Hall, 16385 Church Street, Clarendon, New York on September 4, 2025 at 6:00 p.m.; and be it further

RESOLVED AND ORDERED that the Town Clerk shall give notice of such hearing by publishing a copy of this resolution in the official Town newspaper, and by posting a certified copy of this resolution on the Town’s official sign-board, not less than ten nor more than twenty days before such hearing.

The adoption of the foregoing Resolution was moved by Councilman Allen W. Robinson, seconded by Councilman Bruce A. Hovey, and duly put to vote, which resulted as follows:

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Clarendon, Orleans County, New York, will meet at the Town Hall, 16385 Church Street, in the Town of Clarendon, at six o’clock P.M. on September 4, 2025 for the purpose of conducting a Public Hearing to consider the construction of the facilities and improvements of proposed Water District No. 14  consisting of the installation of 8” PVC water main along portions of Boots Road, Holley Byron Road (NYS Route 237), McAllister Drive, Monroe Orleans County Line Road, Merrill Road, New Guinea Road and Wood Road, within the Town, all of the foregoing to include land or rights in land, original equipment, machinery, furnishings, valves, fittings, connections, fill, appurtenances and related site work and other ancillary work (referred to herein as the “Water District”)  in the Town, at the estimated maximum of cost of $3,122,000 which is planned to be financed by the issuance of  serial bonds to mature in annual installments over a term of up to 40 years offset by any funds received from the federal, state, county, and/or local grants, including, but not limited to grant and/or loan funds from USDA Rural Development, said balance of costs to be provided by the levy and collection of special assessments from the parcels within the District; total estimated first year costs to a typical property and to a typical one or two family home (as defined in Town Law) in the amount of $3,454.72 and total estimated second year and beyond costs to a typical property and to a typical one or two family home in the amount of $1,754.72. The Maps and Plans describing the foregoing, including a detailed explanation of how the estimated cost of the District to the typical property was computed, have been filed in the Town Clerk’s office and are available for public inspection during regular business hours.   At such public hearing, the Town Board will hear all persons interested in said subject matter thereof; and  ALSO BE ADVISED that the Town Board will hold a special meeting upon close of the foregoing Public Hearing to consider establishment of Clarendon Water District No. 14.

CLARENDON RESIDENTS BE ADVISED that Supervisor Marc P. Major has called for a special town board meeting to be held on Friday, August 8, 2025 at 9:00 AM to be held at the Town Hall located at 16385 Church Street, Clarendon, NY.  Purpose of said meeting will be to schedule a public hearing to consider formation of proposed Clarendon Water Improvement Benefit Area No. 14 and to discuss costs allowed for training/education.

TOWN OF CLARENDON NOTICE OF FILING FINAL ASSESSMENT ROLL WITH TOWN CLERK

NOTICE IS HEREBY GIVEN that the Final Assessment Roll for the Town of Clarendon, in the County of Orleans, for the year 2025, has been completed by the undersigned Assessor, and a certified copy thereof will be on file in the Office of the Town Clerk at 16385 Church Street, Clarendon, NY 14429 on the 1st day of July 2025, where the same will remain open to public inspection. TOWN OF CLARENDON NOTICE BY COLLECTOR OF RECEIPT OF ASSESSMENT ROLL AND WARRANT
Property taxes will be received in person at the Clarendon Town Clerk’s Office during regular business hours: Mon., Wed., Thurs. 9:00 AM – 4:00 PM; Tues., 12:00 Noon – 6:00 PM; Fri., 9:00 AM – 2:00 PM; Sat., 10:00 AM – 12:00 Noon; located at 16385 Church Street in Clarendon, NY or may be mailed to PO Box 145, Clarendon, NY 14429 through April 30, 2025.  Checks should be made payable to: Clarendon Tax Collector.  Please note that there is also a drop-box in the building to the west of the office door.  On-line payment of taxes is available on the town website at townofclarendonny.gov , with a 2.65% card fee of the total purchase (minimum of $3.00).  Please bring or send your entire statement when making payment as a portion of your statement will be used as your receipt.  Postmark will be accepted.  Fees charged are as follows: January 0%; February 1%; March 2%; April 3%.

Pursuant to the Public Health Law Section 1399-0, the Town of Clarendon has a written smoking policy for its town employees’ places of employment.  Smoking is prohibited in all indoor places of town employment under the jurisdiction and control of the Town of Clarendon except for those areas specifically designated for smoking.  There are no indoor designated smoking areas at the Town Hall. The entire policy is on file in the Town Clerk’s Office for review upon request.

ATTENTION CLARENDON RESIDENTS: The Planning Board is seeking to fill one alternate Member Position.  There are many issues that deserve someone who is willing to spend two nights a month on the things that affect Clarendon and its residents. The Planning Board deals with land regulations and the development of the town. The Planning Board meets the second and fourth Tuesday of each month and requires the attendance of meetings and public hearings when possible. Responsibilities: To be up-to-date on the Zoning Ordinance, Sub-Division Rules, Master Plan and Town Law and the ability to render unbiased decisions on issuance of special permits, site plan and sub-division review pertaining to the Town of Clarendon. Attend meetings as often as possible or be up-to-date as to any issues that would require the alternates vote. Qualification: Ability to comprehend Town Law, Zoning Ordinance and Sub-Division rules, etc.; Considerable interest in the development of the town and willingness to work independently. CLARENDON PUBLIC WATER CUSTOMERS be aware that November 1st  delinquent water bills, together with penalty, shall become a lien against the real property upon which or in connection with which the water is used. Such a lien is prior and superior to any other lien or claim except the lien of an existing tax.  The Town Board shall include delinquent water charges, penalties and an additional $100 penalty in the annual tax levy and shall levy the same upon the real property in default in accordance with the Town Law.
